Agreement to Terms

By accessing or using Flast, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing Flast.

Flast is an AI assistant platform that provides access to multiple AI providers. By using our service, you acknowledge that you understand the nature of AI-generated content and its limitations.

Account Registration and API Keys

To use Flast, you must create an account using a valid email address. We use a passwordless OTP (One-Time Password) authentication system via email.

You may provide your own API keys for third-party AI providers. If you choose to provide API keys:

• You are responsible for obtaining and managing your own API keys from third-party providers
• API keys are stored encrypted in our database
• You are responsible for any costs incurred with third-party AI providers
• You must comply with the terms of service of each AI provider you use
• Flast is not responsible for any issues arising from the use of your API keys

If you do not provide your own API keys, Flast will use system-wide fallback keys where available. Usage of system keys may be subject to rate limits and availability restrictions.

Acceptable Use

You agree to use Flast only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the service to generate, store, or distribute illegal content
• Attempt to harm, harass, or impersonate others
• Use the service to generate spam, phishing attempts, or malicious code
• Attempt to bypass rate limits or security measures
• Reverse engineer, decompile, or attempt to extract the source code
• Use automated systems to abuse or overload our infrastructure
• Violate the terms of service of any third-party AI provider
• Share your account credentials with others

AI-Generated Content

Flast uses third-party AI models to generate responses. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or inappropriate
• Flast does not guarantee the accuracy, reliability, or suitability of AI responses
• You are solely responsible for verifying and using AI-generated content
• AI responses may reflect biases present in training data
• You should not rely on AI-generated content for medical, legal, financial, or safety-critical decisions
• Flast is not liable for any damages resulting from the use of AI-generated content

User Content and Data

You retain ownership of all content you create, upload, or store in Flast (including chat messages, memories, todos, prompts, artifacts, and files). However, you grant Flast a limited license to:

• Store and process your content to provide the service
• Transmit your content to third-party AI providers as necessary
• Create backups of your content for disaster recovery
• Display publicly published artifacts to visitors who access them via public URLs

You are responsible for maintaining backups of important data. You can export or delete your data at any time through the user interface.

Important: We never sell your data, use it for advertising, or use your content to train AI models. Your data is stored securely and used only to provide the service.

Artifacts and Publishing

Artifacts are documents, code, websites, and other content you create using Flast. By using the artifact feature, you agree to the following:

• All artifacts are private by default and only accessible by you
• You may choose to publish artifacts as 'public' or 'unlisted'
• Public artifacts are accessible to anyone with the URL and may be indexed by search engines
• Unlisted artifacts are accessible via direct link only and are not indexed
• You are solely responsible for all content you publish publicly
• You must not publish content that violates intellectual property rights, contains illegal material, or infringes on third-party rights
• Flast reserves the right to remove or restrict access to published artifacts that violate these terms
• Published artifacts may remain cached or accessible by third parties even after you unpublish or delete them

By publishing an artifact, you represent that you have all necessary rights to the content and that it does not violate any laws or third-party rights.

Playground Templates

Playground provides pre-built AI templates for common tasks. By using Playground, you agree to:

• Use templates only for lawful purposes and in accordance with these Terms
• Not attempt to extract, reverse-engineer, or copy template prompts or configurations
• Accept that AI-generated outputs from templates are subject to the same disclaimers as regular AI content
• Understand that certain templates may require specific subscription plans

Subscription Plans and Credits

Flast operates on a credit-based system. By subscribing to any plan, you agree to the following:

• All plans (including free tier) operate within a monthly credit allocation
• 'Unlimited' features are subject to your plan's credit limits and fair usage policies
• Credits are consumed based on AI model usage, tool usage (image generation, audio generation, etc.), and other platform features
• Unused credits do not roll over to the next billing period
• Credit consumption rates vary by feature and AI model used
• Flast reserves the right to modify credit allocations with reasonable notice
• Subscription fees are non-refundable except as required by law
• Downgrades take effect at the end of the current billing period
• Account cancellation does not entitle you to a refund of unused credits

Credit usage is tracked in real-time and visible in your account settings. When credits are exhausted, access to credit-consuming features will be restricted until the next billing cycle or plan upgrade.

Fair Usage Policy

To ensure quality service for all users, we enforce fair usage limits:

• Automated or programmatic access that exceeds normal human usage patterns may be restricted
• Bulk operations designed to consume excessive resources may be rate-limited
• Accounts showing patterns of abuse may be suspended pending review
• Commercial use of free tier accounts is prohibited
• Sharing account credentials or credit allocations across multiple users is prohibited

Third-Party Services

Flast integrates with the following third-party services:

• AI Providers: Multiple third-party AI services for generating responses
• Email Service: Third-party email service for OTP authentication
• File Storage: Secure cloud storage for uploaded files
• Payment Processing: Third-party payment processor for subscription billing
• Analytics: Third-party analytics services (with your consent)

Each third-party service has its own terms of service and privacy policy. You are responsible for reviewing and complying with their terms. Flast is not responsible for the availability, performance, or policies of third-party services.

Service Availability

Flast strives to provide reliable service but does not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any part of the service at any time
• Impose usage limits or rate limits to ensure fair usage
• Perform maintenance that may temporarily affect service availability
• Terminate accounts that violate these Terms of Service

We will make reasonable efforts to notify users of planned maintenance or significant service changes.

Data Retention and Deletion

You can delete your data at any time through the user interface:

• Individual chats, memories, todos, and prompts can be deleted individually
• Account deletion will permanently remove all associated data
• Deleted data cannot be recovered
• Some data may remain in backups for up to 30 days after deletion

Disclaimer of Warranties

Flast is provided on an 'AS IS' and 'AS AVAILABLE' basis. We make no warranties, expressed or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content
• Warranties regarding uninterrupted or error-free service
• Warranties regarding the security of data transmission or storage

Limitation of Liability

To the maximum extent permitted by law, Flast and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruption or unavailability
• Damages resulting from unauthorized access to your account
• Damages resulting from AI-generated content or third-party services

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Flast and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Your use of third-party AI provider services
• Content you create, upload, or share through the service
• Artifacts you publish publicly, including any intellectual property claims, defamation claims, or other legal issues arising from published content
• Any illegal, harmful, or inappropriate content you generate or distribute using the service

Termination

We reserve the right to terminate or suspend your account immediately, without prior notice, for any reason including:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Request by law enforcement or government agencies

Upon termination, your right to use Flast will immediately cease. You may request a copy of your data before account deletion.

Changes to Terms

Flast reserves the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page and updating the 'Last updated' date.

Continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree to the new terms, you must stop using Flast and may delete your account.

Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Flast shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to participate in class actions or class arbitrations.

Intellectual Property

The Flast platform, including its design, features, functionality, and branding, is the exclusive property of Flast and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our service without prior written permission from Flast.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms of Service will otherwise remain in full force and effect.
